O presidente Jair Bolsonaro assinou nesta quinta-feira (21) decreto que dá indulto ao deputado federal Daniel Silveira (PTB-RJ), condenado pelo Supremo Tribunal Federal (STJ) a oito anos e nove meses de prisão pelos crimes de tentativa de impedir o livre exercício dos Poderes e coação no curso do processo.
O anúncio do indulto foi feito por Bolsonaro por meio de live nas redes sociais. O decreto foi publicado logo após a transmissão, em edição extra do Diário Oficial da União.
Ao ler o documento, o presidente cita considerações como “a prerrogativa presidencial para concessão de indulto individual é medida fundamental à manutenção do Estado democrático de direito” e que “a liberdade de expressão é pilar essencial da sociedade em todas as suas manifestações”.
“Fica concedida graça constitucional a Daniel Lúcio da Silveira, deputado federal condenado pelo Supremo Tribunal Federal em 20 de abril de 2022 no âmbito da Ação Penal nº 1.044 a pena de oito anos e nove meses de reclusão em regime inicial fechado”, destacou Bolsonaro, durante a leitura do texto.
“A graça de que trata este decreto é incondicionada e será concedida independentemente do trânsito em julgado da sentença penal condenatória”. Segundo o presidente, o indulto inclui as penas privativas de liberdade, multa e restritivas de direitos.
Pouco depois, em sua live semanal, Bolsonaro citou que o assunto está pacificado. “É um direito do presidente da República conceder a graça e toda a fundamentação dessa graça está julgada em jurisprudências do próprio senhor ministro Alexandre de Moraes. Portanto, repito: o decreto é constitucional e será cumprido.”

O STF julgou a ação penal aberta em abril do ano passado contra Daniel Silveira, que virou réu e passou a responder a processo criminal pela acusação de incitar à invasão da Corte e sugerir agressões físicas aos ministros do Supremo. Os fatos ocorreram em 2020 e 2021, por meio das redes sociais. O deputado chegou a ser preso, mas foi solto posteriormente.
Com a decisão de ontem (20), Silveira também foi apenado com a perda do mandato e a suspensão dos direitos políticos após o fim dos recursos, o que que poderia tornar o parlamentar inelegível temporariamente. A Corte estipulou ainda multa de cerca de R$ 200 mil como parte da condenação.
