As alterações feitas no Código Brasileiro de Trânsito completam um ano no mês que vem. Desde 2021, os motoristas devem ficar atentos ao número de pontos que podem gerar a suspensão de dirigir por até um ano. No caso de reincidência, a restrição pode chegar a dois anos, além do pagamento de multas.
O limite de pontos que pode levar à suspensão da Carteira Nacional de Habilitação (CNH) passou de 20 para 40. No entanto, o total de pontos para perder a carteira temporariamente pode diminuir conforme a quantidade de multas gravíssimas acumuladas pelo condutor.
De acordo com o código, a CNH só é devolvida ao motorista após o término da penalidade e do curso de reciclagem, que é obrigatório.
Se o motorista for flagrado pela fiscalização dirigindo um veículo com a carteira suspensa, terá que pagar multa de aproximadamente R$ 900, terá o veículo retido até a chegada de outra pessoa habilitada, além da cassação da carteira por dois anos.
Nova pontuação
Antes da entrada em vigor das alterações, o motorista que atingisse 20 pontos durante o período de 12 meses ficaria com a carteira suspensa. Agora, a suspensão ocorre de forma escalonada. O condutor tem a habilitação suspensa com 20 pontos (se tiver duas ou mais infrações gravíssimas, 30 pontos (uma infração gravíssima na pontuação); 40 pontos (nenhuma infração gravíssima na pontuação).
No caso do motorista que exerce atividade remunerada, como taxistas e de aplicativos de transporte, a suspensão ocorre somente quando atingir o número fixo de 40 pontos, independentemente da gravidade da infração.
A multa gravíssima é de R$ 239,37 e gera sete pontos na CNH. O motorista comete esse tipo de infração ao dirigir falando ao celular, avançar sinal de trânsito, andar na faixa exclusiva de ônibus, parar em vaga destinada à pessoa com deficiência, entre outras condutas
As demais infrações geram menos pontos – grave (cinco pontos), média (quatro pontos) e leve (três pontos).
Para consultar o número de pontos na carteira, o motorista pode acessar o site do Detran de seu estado ou baixar o aplicativo oficial CNH Digital para celulares.
