O ministro do Supremo Tribunal Federal (STF) Alexandre de Moraes determinou neste sábado (19) que o Telegram cumpra, em até 24 horas, as decisões judiciais emitidas pela Corte que ainda estão pendentes. Segundo a decisão de Moraes, o cumprimento das pendências neste prazo é o que evitará a suspensão da plataforma no Brasil.
“O Telegram, até o presente momento, cumpriu parcialmente as determinações judiciais, sendo necessário o cumprimento integral para que seja afastada a decisão de suspensão proferida em 17/3/2022.”
O ministro citou ainda o pedido de desculpas divulgado em nota pelo fundador do Telegram, Pavel Durov. Na decisão, ele reproduziu a declaração de Durov, que afirmou ter tido problemas com os endereços de e-mails corporativos, o que impediu que a plataforma fosse comunicada sobre as decisões do STF sobre bloqueio de perfis investigados.
“Parece que tivemos um problema entre nossos e-mails corporativos e a Suprema Corte brasileira. Como resultado dessa falha de comunicação, a Corte baniu o Telegram por não responder”, declarou Durov.
A lista de pendências indicadas por Alexandre de Moraes na decisão inclui:
– indicação da representação oficial do Telegram no Brasil;
– informação, imediata e obrigatoriamente, de todas as providências adotadas para o combate à desinformação e à divulgação de notícias fraudulentas, incluindo os termos de uso e as punições previstas para os usuários que incorrerem nas mencionadas condutas;
– imediata exclusão ou retirada das publicações divulgadas no link https://t.me/jairbolsonarobrasil/2030, preservando o seu conteúdo, com disponibilização ao STF (as informações são referentes a inquérito sigiloso e não concluído pela Polícia Federal)
– bloqueio do canal Claudio Lessa com o fornecimento de seus dados cadastrais ao STF e a integral preservação de seu conteúdo.

Moraes atendeu a pedido da Polícia Federal e determinou o bloqueio, que ocorreu no âmbito de uma investigação em andamento na Corte envolvendo o jornalista Allan dos Santos.
Ontem (18), o fundador da plataforma, Pavel Durov, informou que vai nomear um representante legal para o Brasil e pediu que o STF reconsidere a decisão de suspensão.
Em fevereiro, Moraes havia determinado que o aplicativo de mensagens fizesse o bloqueio de perfis acusados de disseminar desinformação, no entanto, o STF não conseguiu intimar a representação no Brasil da empresa responsável pelo aplicativo.
Em outra frente, no início do mês, o Tribunal Superior Eleitoral (TSE) também tentou localizar os representantes da empresa, por meio do escritório de advocacia no Brasil. Um ofício foi endereçado a Pavel Durov.
Segundo a Polícia Federal, o aplicativo é “notoriamente conhecido por sua postura de não cooperar com autoridades judiciais e policiais de diversos países”.
